Preservation Planning

Scope and Timing

• Data365 proceeds under a client-approved scope and with authorization to access the identified sources.
• Where relevant, the approved scope also defines date ranges, data categories, folders, and other limits.
• Preservation timing accounts for known deadlines, retention limits, access changes, and device return or turnover dates.
• Continued use of a device, account, or system may affect preservation timing or method selection.
• Data365 Evidence assesses each source and selects the appropriate preservation or acquisition method. For drives and devices, Data365 selects from the acquisition methods approved by the client.
• Written approval is required before adding sources, expanding the scope, or using an acquisition method that has not been approved.

Source Conditions

• The approved scope covers all devices, accounts, repositories, and other sources to be preserved.
• Data365 documents source conditions that may affect preservation.

Access and Availability Constraints

• Constraints are documented when they may affect preservation.
• Provider restrictions such as export limits or time-sensitive download links may affect preservation.

Matter Records

• Chain-of-custody record
• Preservation or acquisition documentation
• Integrity verification (when applicable)

For drives and devices, acquisition documentation identifies the method used and records whether it was within the client-approved acquisition options.
